Challenge

In the heart of the UK, a public health organization faced a daunting challenge. Tasked with delivering critical health services across a region, they were also under pressure to achieve demanding financial savings targets. Approach

Following an initial analysis by Proxima, it became evident that the supplier was responsible for a series of both commercial and operational failings across several key delivery components. Proxima was tasked with a critical mission: to deliver a supplier negotiation to compensate for the strategic supplier’s contractual breaches. This was a complex negotiation; it required a meticulous approach, a deep understanding of the contracts, and a robust strategy to drive value and achieve key outcomes. 

Beginning with a thorough contract analysis, Proxima conducted a deep dive into multiple contracts, utilizing both spend data and contract management documentation to build a detailed analysis of the supplier’s failings and the associated saving opportunity values. This analysis was the foundation upon which the negotiation strategy would be built. 

Next, Proxima amplified the ‘voice’ of Procurement within the client organization. Achieving executive stakeholder buy-in was crucial to challenge the key legacy supplier. Proxima’s team worked tirelessly to ensure that the procurement team’s concerns were heard and that there was a unified front going into the negotiations. 

With stakeholder buy-in secured, Proxima developed a robust negotiation strategy. This strategy was informed by a detailed analysis outlining the available levers to drive value and achieve the desired outcomes. It was a strategy built on facts, data, and a clear understanding of the supplier’s contractual breaches. 

Results

Proxima delivered the negotiation in person, ensuring that the supplier understood the seriousness of the situation and the need for significant value to be secured for the client. The negotiation delivered a dual benefit: it rectified the immediate financial discrepancies caused by the supplier’s breaches and established a more cost-effective framework for future engagements.

By addressing the supplier’s failings and establishing a more robust contractual framework, Proxima helped the client build a foundation for sustained operational excellence. Additionally, the negotiation process empowered the client’s procurement team, amplifying their voice within the organization and fostering a culture of accountability and continuous improvement. The lessons learned from this negotiation were applied to other supplier relationships, driving further efficiencies and enhancing the overall procurement strategy.
